In January of 2002, the Fair Credit
Reporting Act (FCRA) became law. The FCRA
was created to ensure the accuracy and privacy
of the information contained in credit reports.
Because it is a reason of a valid business
nature, a landlord is legally permitted to
take adverse action against rental applicants
if their landlord tenant credit checks return
poor results. Adverse action might include
rejection of the rental application, requiring
that the applicant have a co-signer on their
lease, requiring an additional or larger deposit,
or charging the applicant higher rent.
The FCRA outlines a very specific procedure
that must be followed when an adverse action
is taken against an individual due to a poor
landlord tenant credit check. Once the landlord
has reached a decision, he must provide the
applicant with an adverse action notice. This
notice must include the contact information
of the credit reporting agency (CRA) that
provided the credit report as well as a statement
that the CRA did not make the adverse decision
and cannot explain it. The notice must also
state the tenant's right to a free copy of
her credit report within 60 days of the decision
as well as her right to dispute the findings
of the CRA.
Although property owners must be careful
when using landlord tenant credit checks,
they can be a huge aid to a busy landlord.
Credit reports obtained directly from CRAs
are often time consuming to obtain as well
as lengthy and difficult to understand. The
agencies that specialize in tenant screenings
and credit checks will not only do all of
the legwork in terms of obtaining tenant credit
reports, they will also interpret them for
the landlord. As long as they are used legally,
landlord tenant credit checks can be an extremely
helpful tool for any landlord.
Tenant credit check can be performed
various ways. Traditionally individual owners
have gone to their local apartment association
where as larger properties and property management
companies work with tenant screening companies.
10-15 years ago the tenant credit check was
not commonly used when renting to a new resident.
Even in today's market, many individual owners
are not performing a tenant credit check on
their prospective renter. This usually comes
back to "bite" the landlord when
the tenant doesn't pay their rent or seriously
damages the rental unit.
